Jointly Build the Foreign Law Ascertainment (Southwest) Center

and Mediation Center for Belt and Road Initiative

for the Promotion of International Business Environment

In the morning of May 21, 2019, Mr. Yuan Zongyong,  Secretary of the Leading Party Members' Group and Mr. Peng Fugui, Deputy Director of Chengdu Justice Bureau made a survey trip to Beijing Retio Legal and Commercial Service Center for Belt and Road Initiative. The two sides signed a cooperation agreement on jointly establishing the Foreign Law Ascertainment (Southwest) Center for Belt and Road Initiative to promote the construction of international business environment in Chengdu. This cooperation followed the signing of the agreement to build International Commercial Mediation (Southwest) Center for the Belt and Road on September 19, 2018.

Mr. Yuan Zongyong, Secretary of the Leading Party Members' Group, introduced the judicial administration and legal services in Chengdu. He pointed out that the Chengdu Municipal Party committee and government have designated 2019 as the year for creating an international business environment, and are accelerating to build a law-based, international and convenient business environment. In particular, foreign law ascertainment as a commercial legal service is an important legal guarantee for the business environment, and covers all aspects and stages of government services, social, economic, and trade development and cultural exchanges. Mr. Yuan also introduced Chengdu's work progress in jointly building the mediation center, arbitration center and foreign law ascertainment center. By introducing high-quality legal service resources, and relying on the cooperation and support of local courts, judicial bureaus and other departments concerned, Chengdu is trying to build a legal service platform that is open up to the outside world to accumulate more elements and resources, and provide comprehensive legal services, including commercial mediation, for enterprises from Chengdu and surrounding areas in their global expansion.

 

Dr. Wang Li, Director of the International Commercial Meditation Center for the Belt and Road, praised Chengdu's new thinking and new measures of judicial administration. Then she shared her experience in attending the 2nd Belt and Road Summit for International Cooperation and in hosting Beijing Initiative on the Belt and Road Service Connections Seminar. At the local cooperation forum, she pointed out that professional service agencies of various countries had agreed through “jointly consultation” to establish the Belt and Road Service Connections (BNRSC) to "jointly construct" the "Belt and Road" professional service capacities and "jointly share" the benefits thus generated. She also introduced the evolution of the BNRSC and its functions in project docking, risk mitigation, compliance service and dispute resolution. She said that the International Commercial Meditation Center for the Belt and Road, established by Beijing Retio Legal and Commercial Service Center, has adopted a working mode featuring the connection of mediation and litigation services, mediation and arbitration services, mediation and notarization services, online and offline services, and domestic and overseas services, which has been proved effective. During the summit, Guangming Daily and Xuexi Network reported on the BNRSC and the International Commercial Meditation Center for the Belt and Road. As to joint development of the foreign law ascertainment center, Director Wang Li pointed out the necessity and existing problems, and shared her views on how to build a more convenient and universal center through cooperation. The two sides reached consensus on in-depth cooperation and agreed on the next stage of work.

 

It is reported that after signing the cooperation agreement, Beijing Retio Legal and Commercial Service Center for Belt and Road Initiative and Chengdu Justice Bureau will jointly promote the establishment and operation of the extraterritorial law ascertainment institution in Chengdu according to the agreement, and conduct in-depth cooperation on the law ascertainment mechanism research and ascertainment rules to create an international business environment in Chengdu through innovations.

"The parties hereby agree that any dispute or difference arising from or in connection with this contract shall firstly be submitted to the International Commercial Mediation Center for the Belt & Road ("the Center") for seeking settlement by mediation in accordance with its then effective mediation rules, which are to be automatically incorporated into this clause."
